This Privacy Policy describes the information that the Company gathers, in what ways that information is used, and the options that you have to access, correct, or delete such information.
Definitions
“Company” (or “we,” “us,” or “our”) means proxiML, Inc., a Delaware Corporation, having its principal place of business at 813 Forest Ave, Oak Park, IL 60302. This includes services provided under the brands proxiML®, trainML®, CloudBender® and accessed via proximl.ai, trainml.ai, or related domains.
“Personal Data” means any information relating to an identified or identifiable natural person, as defined under applicable data protection laws including the GDPR.
“Controller” and “Processor” have the meanings given in the GDPR. For clarity, we act as a Controller for Personal Data we collect for our own purposes (e.g., account management) and as a Processor for Personal Data you input through our Services on behalf of your end-users. In the latter case, we process such data only on your instructions and recommend entering into a Data Processing Agreement (DPA) with us to outline our limited obligations. Due to the unique the Company's Services architecture, most data used by the Services is processed by the Customer, not the Company. In this case, the Company acts an neither a Controller or Processor.
Our Promise
You own your data. We are here to help you get the most out of it. We want to be transparent in this regard, and we strongly believe in keeping your personal information personal, private and secure. We will not sell, rent, or otherwise share your personal information to anyone except as required to provide our service or as otherwise outlined in this Policy, or for our legitimate business interests such as aggregated analytics or service improvements. Where consent is the legal basis for processing (e.g., marketing), we will obtain it explicitly and allow easy withdrawal.
Who Does This Policy Apply to
Customers: Any person that registers individually or on behalf of an entity or organization in order to use Company Services.
Website Visitors: Visitors to https://www.proximl.ai, https://docs.proximl.ai, https://app.proximl.ai, https://www.trainml.ai, https://docs.trainml.ai, https://app.trainml.ai, as well as others that may opt in to receive commercial communications from the Company.
The Company does not knowingly collect information from children under the age of 13.
This Policy applies globally to all users of our Services. We process Personal Data in compliance with applicable data protection laws, including but not limited to:

We collect your personal information in order to provide our Services.

How Do We Use Information We Collect
The Company only processes personal information in a way that is compatible with and relevant for the purpose for which it was collected or authorized. We process Personal Data based on legal bases such as: (i) your consent (e.g., for marketing); (ii) necessity for the performance of a contract (e.g., providing Services); (iii) our legitimate interests (e.g., analytics, security, improvements, where these do not override your rights); or (iv) legal obligations. We may also use anonymized or aggregated data (which is not Personal Data) for any business purpose, such as research, benchmarking, or developing new features, without restriction.
When We Share Information
We retain the services of other companies that help us to run our business (“Service Providers”). These companies provide services such as cloud hosting, payment processing, analytics, customer management, support, and more to help us provide support, marketing activities, and otherwise operate and improve our Services. We share only as necessary for legitimate interests or contractual performance, and require them to process data only on our behalf via contracts with appropriate safeguards. The Company commits to cooperate with USA data protection authorities (DPAs) and comply with the advice given by such authorities with regard to human resources data transferred from the USA in the context of an employment relationship. For transfers outside the EEA, we use safeguards such as the EU Standard Contractual Clauses to protect your data.
We do not permit our Service Providers to use any personal information we share with them for their own marketing purposes or for any other purpose than in connection with the services they provide to us.
In addition to sharing with Service Providers as described above, we may also share your information with others in the following circumstances:
- With our resellers and other sales partners who may help us distribute the Services to Customers;
- In the event of a merger, sale, change in control, or reorganization of all our part of our business;
- When we are required to disclose personal information to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
- Where we have a good-faith belief sharing is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Service Agreement, or as otherwise required to comply with our legal obligations; or as you may otherwise consent from to time to time;
- We may share anonymized data freely for business purposes.
When We Link to Other Websites
This Privacy Policy applies only to the Services. The Services may contain links to other web sites not operated or controlled by the Company (the "Third Party Sites"). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that the Company endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.
How We Store Information
The Company is an Delaware Corporation which primarily stores your information in the United States. We retain Personal Data only as long as necessary for the purposes outlined. After that, we delete or anonymize it based on criteria like legal requirements and business needs. To facilitate our global operations, we may transfer and access such information from around the world, including from other countries in which the Company has operations to provide the Services.
If you are accessing or using our Websites or Services or otherwise providing information to us, you are agreeing to the transfer of your personal information to the United States and other jurisdictions in which we operate.
We retain categories of personal information as described in 'What Information Do We Collect' for the periods necessary for the purposes outlined, or as required by law.
If you are in the EEA, your data may be transferred to the US or other countries. We ensure adequate safeguards, such as Standard Contractual Clauses, to protect it in line with GDPR.
What Are Your Data Rights
You also have the right to restrict processing, object to processing (e.g., for direct marketing or legitimate interests), and data portability (receive your data in a structured format for transfer). Where processing is based on consent, you may withdraw it anytime without affecting prior lawfulness. We respond to verified requests within one month (extendable if complex), free of charge unless excessive. You have the right to complain to your local supervisory authority (e.g., in the EU). You may also email us at support@proximl.ai with any subsequent subject access requests (use the term “SAR” as your email subject line), and we will respond within thirty (30) days. Customers also can access, correct, export, or update their Account Information by editing their profile or organization record at https://app.proximl.ai.
California Residents' Rights (Under CCPA/CPRA):
If you are a California resident and we are subject to CCPA, you have the right to:
- Know the categories of personal information we collect, sources, purposes, and whether it's sold or shared (see "What Information Do We Collect" and "How Do We Use Information We Collect").
- Opt out of the sale or sharing of your personal information (we do not currently sell or share personal information as defined under CCPA, but if this changes, we will update this Policy and provide an opt-out mechanism).
- Limit the use of sensitive personal information (if applicable; contact us to exercise).
- Correct inaccurate personal information.
- Non-discrimination for exercising rights.
To exercise these rights, submit a verifiable request via support@proximl.ai. We respond within 45 days (extendable). We may require verification and charge for excessive requests as permitted. We do not offer financial incentives related to personal information.
How to Change Your Communication Preferences
To keep your information accurate, current, and complete, please contact us as specified below. We will take reasonable steps to update any information in our possession that you have previously submitted via the Services. Note that you may also manage your communications preferences and the receipt of any commercial communication by clicking the “unsubscribe” link included at the bottom of all marketing-related emails from the Company. You may also adjust your preferences through your account settings if you have a the Company account, or else send an email to support@proximl.ai. Opting out does not affect communications necessary for contractual purposes.
How We Handle Data Security, Integrity, and Access
The Company takes all reasonable steps to protect the data that we receive from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. We utilize appropriate physical, digital, and administrative protocols to keep your information secure, including the use of encryption services. However, no transmission or storage is 100% secure, and we cannot guarantee absolute security. In the event of a breach affecting your data, we will notify you and authorities as required by law (e.g., within 72 hours under GDPR). In particular, email sent to or from the Services may not be secure. Therefore, take special care in deciding what information you send to us via email. How We Will Notify You about Changes
The Services and our business may change from time to time. As a result, at times it may be necessary for the Company to make changes to this Privacy Policy. The Company reserves the right to update or modify this Privacy Policy at any time and from time to time without prior notice. However, if we make changes that we believe will materially impact this Privacy Policy, we will promptly notify you of those changes and obtain consent (where applicable or required). Please review this Privacy Policy from time to time. Your continued use of the Services after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy. For material changes (e.g., new purposes), we will notify you via email or prominent notice on our site and, where required, obtain consent. Non-material changes may take effect immediately upon posting.
How We Will Handle a Business Transfer
As we develop our business, we may sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, we may assign or transfer this Policy, as well as all information covered thereunder. In such events, the transferee will be bound by this Policy or a substantially similar one.
